MES Cooling Solutions – Terms & Conditions of Sale

These Terms & Conditions apply to purchases made from MES Cooling Solutions through our website, quotations, invoices or other agreed sales channels.

1. Prices and VAT

Unless expressly stated otherwise, all prices displayed on our website are exclusive of VAT. VAT will be added at the applicable UK rate.

Prices are also exclusive of delivery, carriage, unloading and installation charges, unless specifically stated otherwise in writing.

2. Collection and Delivery

Our standard prices are based on goods being supplied ex-warehouse / collection from our warehouse.

Customers may arrange collection using their own suitable vehicle or carrier.

Where requested, MES Cooling Solutions may arrange or quote for delivery separately. Delivery charges will depend on factors including the products ordered, quantity, weight, dimensions and delivery postcode.

Any delivery charge will be confirmed before the order is finalised where delivery is arranged by us.

Unless specifically agreed in writing, unloading at the delivery location is the customer's responsibility.

3. Orders

Submission of an order does not automatically constitute acceptance by MES Cooling Solutions. We reserve the right to verify product availability, specifications, pricing, delivery requirements and payment before accepting an order.

Where an obvious pricing, technical or description error has occurred, we may contact the customer to correct the order before accepting it.

4. Product Specifications

Customers are responsible for checking product dimensions, specifications, quantities and suitability for their intended application before ordering.

Product photographs and illustrations are provided for general guidance. Minor variations in appearance, finish, colour or manufacturing tolerances may occur where they do not materially affect the product's intended use.

5. Made-to-Order and Bespoke Products

Products manufactured, cut, modified or specially sourced according to customer requirements may be subject to additional terms.

This includes, without limitation, made-to-measure cold room doors, cut-to-size insulated panels and specially manufactured or sourced components.

Customers must carefully check and approve measurements and specifications before production or modification begins.

Once manufacture, cutting or modification has commenced, cancellation or return may not be possible, except where required by applicable law or where the goods are faulty or do not conform to the agreed specification.

6. Payment

Payment may be made using the payment methods available at checkout or, where agreed, by bank transfer directly to MES Cooling Solutions.

For trade, bulk, project, made-to-order or specially sourced products, we may issue a quotation or pro-forma invoice and request payment by bank transfer.

MES Cooling Solutions may require full or partial payment before goods are manufactured, modified, released for collection or dispatched.

Bank account details will be provided directly on our official quotation, pro-forma invoice or invoice. Customers should ensure that payment is made using the correct order or invoice reference.

Goods will not normally be released or dispatched until cleared payment has been received, unless alternative credit terms have been agreed in writing.

7. Availability

Products shown on our website may be subject to stock availability. We cannot guarantee continuous availability of every product, size or specification.

Where an item is unavailable, we may contact the customer to discuss alternatives, revised lead times or cancellation where appropriate.

8. Delivery Times

Any delivery or availability dates provided are estimates unless expressly agreed otherwise in writing.

We will make reasonable efforts to meet agreed timescales but may not be responsible for delays outside our reasonable control.

9. Returns and Refunds

Returns, cancellations and refunds are governed by our Returns & Refunds Policy, together with any applicable statutory rights.

Customers should inspect products before installation, cutting, drilling or modification.

10. Business and Trade Customers

Separate terms contained in a quotation, pro-forma invoice, order confirmation, invoice or written agreement may apply to business, trade, project and bulk orders.

Where specific terms have been agreed for an individual order, those terms will apply to that order to the extent that they differ from these general terms.

11. Liability

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

MES Cooling Solutions will not be responsible for loss arising from incorrect installation, misuse, unauthorised modification or use of a product for a purpose for which it was not designed.

12. Statutory Rights

Nothing in these Terms & Conditions is intended to exclude or restrict any statutory consumer rights that cannot legally be excluded or restricted.
